| The
Utah Tobacco Quit Line contractor, Free & Clear,
Inc. is concerned about client privacy. Free & Clear,
Inc. follows these protocols to ensure client confidentiality
and to comply with state and federal law:

| FAXING
HEALTHCARE INFORMATION
|
| Disclosure
of health information via fax machine is permitted as
follows: |
| |
Between
Free & Clear, Inc. facilities, business or operations
units, and business associates to support care and operations,
|
| |
To
a physician or healthcare provider that is providing
health related services to a Free & Clear program
participant, and
|
| |
To
Free & Clear clients or third party payers as required
for billing purposes.
|
| The
procedure for disclosing health information via fax
is as follows: |
| |
A "Facsimile Cover Letter" must be used to
send faxes containing PHI. All pages plus the cover
page of all confidential documents to be faxed must
be marked "Confidential" before they are transmitted.

| |
Limit
the information being faxed to the minimum information
necessary to serve the purpose.
|
| |
Personnel
must make reasonable efforts to ensure that they send
the facsimile transmission to the correct destination.
|
| |
Faxes should be immediately removed from the fax machine
and delivered to the recipient.
|
| |
Destroy, or follow sender’s instructions for
participant information faxed in error and immediately
inform the sender.
|
| The
Free & Clear, Inc. approved confidentiality statement
for facsimile cover sheets is as follows:

The
documents accompanying this facsimile transmission
may contain confidential information, belonging to
the sender, that is protected by Washington state
and/or federal law. This information is solely for
the use of the addressee named above. You may be exposed
to legal liability if you disclose this information
to another person. If you are not the intended recipient,
you are hereby notified that any disclosure, copying,
distribution, or other use of the contents of this
faxed information is strictly prohibited. If you have
received this facsimile in error, please notify the
sender immediately by telephone and confidentially
dispose of the material.
